Unless your employer is a government agency, a church, or a small company there are special challenges involved in suing an insurance provider sponsored by your employer. Your group health plan, life insurance, and long-term disability insurance, if provided through your employer, are protected by the federal Employee Retirement Income Security Act (ERISA) from the usual process. Employees pursuing a claim against an employer-sponsored plan first have their case reviewed in an administrative process. This is a critical stage – no evidence omitted at this stage will be heard later. ERISA claimants are denied a jury trial, but we can try the case before a judge in Federal Court.
