ERISA – the process of suing your employer-sponsored insurance provider.

In an ERISA case, we do a video of our client’s statement and request that it become part of the record in the administrative hearing. That way, the federal judge who later hears the lawsuit will be able to see the client’s testimony.

Unless your employer is a government agency, a church, or a small company there are special challenges involved in suing an insurance provider sponsored by your employer. Your group health plan, life insurance, and long-term disability insurance, if provided through your employer, are protected by the federal Employee Retirement Income Security Act (ERISA) from the usual process.

Employees pursuing a claim against an employer-sponsored plan first have their case reviewed in an administrative process. This is a critical stage – no evidence omitted at this stage will be heard later.

ERISA claimants are denied a jury trial, but we can try the case before a judge in Federal Court. Clark & Warzynski, P.A., is one of the few firms prepared to represent clients in these proceedings. In a current case, we are challenging a hospital’s claim of ERISA status.

Private Disability Insurance

Private disability insurers and group health plan providers can, however, be sued in state courts in coverage disputes or when they fail to pay medical benefits or disability claims. These cases may involve insurance bad faith lawsuits.
